Public Consultation on Exemptions to Prohibition Against Circumvention of Technological Protection Measures



IPOS is conducting a public consultation on the exemptions to prohibition against circumvention of technological protection measures.

Background

A technological protection measure is defined in the Copyright Act as any technology, device or component that, in the normal course of its operation, prevents or limits any unauthorised use of a copyright work or subject matter. Section 261C of the Copyright Act (Cap. 63) prohibits the circumvention of technological protection measures applied to copyright works and subject matter.
For example, the act of bypassing passwords used to restrict access to copyright works would be prohibited.

The purpose of this public consultation is to determine whether there are specific classes of copyright works or subject matter for which this prohibition may present adverse effects on users who intend to carry out non-infringing uses of the copyright works or subject matter.

Issues for Public Consultation

In preparation for the next Copyright (Excluded Works) Order that will be issued by the end of 2012, feedback is sought on whether:
  1. The existing list of excluded works should continue to be exempted from the prohibition against circumvention of technological protection measures as applied to them;

  2. There are any other specified copyright works or subject matter; or specified classes of copyright works or subject matter, which should be exempted from the prohibition against circumvention of technological protection measures as applied to them.
Members are encouraged to provide feedback on the issues. Members are requested to first identify the issue and then provide reasons why the exemption should apply. Such reasons should include, in particular, how the prohibition would otherwise adversely affect non-infringing uses of the specified copyright work or subject matter; or specified classes of copyright work or subject matter.
